Your Entitlements

What you may be entitled to after a back injury at work in Queensland

If you have suffered a back injury at work in Queensland, the WorkCover Queensland scheme may entitle you to a range of support. Many injured Queensland workers do not realise the full scope of what is available, especially if they are running a WorkCover claim on the Gold Coast and have not spoken to a lawyer. Depending on your circumstances, you may be entitled to:

  • Weekly income replacement payments while you recover
  • All reasonable medical, rehabilitation, and hospital costs covered
  • A lump-sum payment for permanent impairment
  • Retraining and return-to-work support
  • Travel costs to medical appointments
  • Domestic and personal care assistance

Superannuation and TPD entitlements: often unclaimed

Many Queenslanders do not realise they may have Total and Permanent Disability (TPD) insurance within their superannuation fund. If your back injury means you can no longer work in your usual occupation, you may be entitled to a lump-sum TPD payment from your super fund, in addition to your WorkCover entitlements.

Stuart MacLeod’s team checks your superannuation fund as part of every back injury claim to make sure no entitlement is overlooked.

After Your Injury

What to do after a back injury at work in Queensland

After a back injury at work in Queensland, the steps you take in the first few days matter. They protect your health and they protect your entitlements. Here is what we recommend.

  1. Get medical attention first See your GP or go to hospital straight away. A medical record from the day of the injury is one of the most important pieces of evidence in any claim.
  2. Report it to your employer in writing Even a short email or text message is enough. Keep a copy for yourself. Verbal-only reports are easy to dispute later.
  3. Ask for a WorkCover claim number Your employer or your doctor can lodge a claim on your behalf, or you can lodge directly with WorkCover Queensland. A claim number protects your right to entitlements while you recover.
  4. Keep every record Save copies of every medical certificate, receipt, payslip, and email about the injury or your return-to-work plan. Records you do not keep are records you cannot rely on.
  5. Speak to us about time limits Statutory claims and common law claims have different time limits. A short, free conversation now can protect rights that are easy to lose later.

Common Back Injuries

Common back injuries we see at work

A back injury at work in Queensland can cover a wide range of conditions. Some come from a single incident on a job site. Others build up over months or years. These are the patterns we see most often across Queensland’s construction, manufacturing, warehousing, and transport industries.

Lifting strains

Lifting too much, lifting awkwardly, or lifting without help is the single most common cause of workplace back injury. Symptoms can range from short-term muscle pain to lasting nerve damage.

Herniated or slipped discs

Often caused by lifting, falls, or repeated bending. A herniated disc can press on a nerve and send pain down the leg. It can take months to recover and sometimes requires surgery.

Sciatica

Pain that runs from the lower back down a leg, often a sign of nerve compression in the spine. Common after lifting injuries and disc injuries. Can affect your ability to stand, walk, or drive.

Soft tissue injuries

Strains and sprains of the muscles and ligaments around the spine. Common in repetitive-strain work and after slips, trips, and falls. Often underestimated until they affect daily life.

Repetitive strain injuries

Build up over months or years of repeated lifting, bending, twisting, or vibration. Common in warehousing, on production lines, and behind the wheel. WorkCover covers these as well as single-incident injuries.

Spinal cord injuries

The most serious category, usually caused by falls from height or being struck by a heavy object. Can cause lasting loss of movement or sensation. Almost always involves significant TPD and common law entitlements alongside WorkCover.

Frequently Asked

Common questions about back injury claims in Queensland

If you have injured your back at work in Queensland, whether from a single incident or from repetitive strain over time, you may have entitlements under the WorkCover Queensland scheme. Contact us for a free, no-obligation assessment.
Five things, in order. See your GP or go to hospital. Report the injury to your employer in writing, even a short email or text. Ask for a WorkCover claim number. Keep every record, including medical certificates, payslips, and emails. Speak to a lawyer about time limits before they run out.
Lifting strains, herniated or slipped discs, sciatica, soft tissue injuries from slips and falls, and repetitive strain injuries that build up over months or years. WorkCover Queensland covers all of these as well as more serious spinal cord injuries.
There is no fixed answer. It depends on the type and severity of the injury, your treatment plan, and your job. While you are unfit for work, WorkCover may pay weekly income replacement payments. Your doctor sets your work capacity in your medical certificates.
A rejection does not mean your entitlements are gone. Insurers sometimes reject valid claims at first. Stuart MacLeod’s team has deep experience challenging rejected claims and securing entitlements that were initially denied.
No. It is unlawful in Queensland for an employer to dismiss you, demote you, or treat you adversely because you made a WorkCover claim. If this happens, you may have separate legal rights under workplace laws on top of your WorkCover entitlements.
Potentially, yes. Many workers have TPD insurance within their super fund without knowing it. If your back injury means you can no longer work in your usual occupation, you may be entitled to a lump-sum TPD payment. Stuart’s team checks your super as part of every claim.
Strict time limits apply. WorkCover statutory claims generally need to be made within 6 months of the injury, and a common law claim commenced within 3 years. Contact us as soon as possible to protect your rights.
The vast majority of claims settle through negotiation without ever going to court. Stuart MacLeod prepares every claim thoroughly and negotiates firmly on your behalf.
