What will be covered from a broken bone under WorkCover?

Once the extent of your injury has been independently assessed, the degree to which your broken bone prohibits you from continuing work can lead to several compensatory options.

WorkSafe can pay you weekly payments whilst you recover from your injury and are unable to complete the same quantity of hours pre-injury, where the calculation of weekly payments is dependent on your current work capacity. Entitlements can also include payment for medical expenses and can extend to a one-time permanent impairment payout, whereby you may be awarded a lump-sum payment if it is determined your injuries meet the threshold.

However, if you believe your injury was the negligence of your employer, you may be able to pursue a common law claim for further compensation. To pursue a claim for a fractured bone, the degree of your injury must be to the extent that it is considered ‘serious’, from the negligent behaviour of your employer.

If you are not able to work due to a broken bone or fracture you may also be entitled to making a TPD insurance claim through your super.
